Government Start Consultation on Raising Small Claims Limit
The government have started a consultation on raising the small claims limit on personal injury cases from £1,000 to £5,000. This would mean that the vast majority of claimants with genuine whiplash injuries would have limited access to justice unless they represented themselves against large, wealthy insurance companies. This could also see an end to no win no fee agreements for most claims as solicitors would not have their costs paid by insurers in cases that fell into the proposed small claims bracket and would need to recover their costs from their clients.
In 2007 a consultation found that there was no justification in raising the small claims limited, but the government has decided to consult on the issue again.
